Department Decision ChallengedDate:25.08.2017
A mother successfully challenged a recent decision by the Department of Social Protection.
A mother caring for her teenage son, who had mental health issues, was awarded more than €10,000 in arrears for carer’s allowance after challenging a decision by The Department of Social Protection to stop paying it.
The Department had stopped the carer's allowance in June 2016 on the basis she did not qualify for it because her son no longer needed full-time care and attention. The decision was made following a desk-based medical assessor’s report, written without visiting the woman’s home to assess her son’s needs.
Congratulations to the team at Community Law and Mediation Centre in Coolock, north Dublin, who assisted the mother in her legal challenge.
